Disgruntled Employee creating problem

Dear Forum,

    I am HR head in a small firm in Coimbatore, one employee recently resigned and we slapped notice period clause even though it was unfair on our part. The employee in question left company as he was not confirmed after 6 months of probation. But for relieving letter we unethically took three months salary.

   The employee by protesting finally paid up , but after this he has made very bad derogatory remarks on company and key individuals on consumer/product website by name www.mouthshut.com , this is affecting our business and public image though we accept our mistake.

   How to deal with the situation, please help, Does legal case under cyber laws against him work  ? How much time it will take to take action on employee ? We want the derogatory remarks to go off ASAP.

Please Advice some  workable solution

Best remedy would be for a senior official to meet the employee, preferably at a common place and accept the moral responsibility for the lopside and resolve the matter.  It should work rather than trigerring a vexatious dispute.

Hi,

What he did not not amounts to defamation for any such criminal act since he published the truth only which concerning him with the company. if he has published anything with the intention to defame company and its staff it will be treated as defamtion and you can file criminal as well as civil case for damages.

Learned Mr. Vasudevan nad Mr. Menon have given valuable advice.Kindly follow it.

HR and HR head should be reasonable.

After being unreasonable the company is still exploring ways and means and situation may become tit for tat.

Pushed beyond the threshold limit this employee can proceed legally.

As rightly adviced refund the hard earned monies, express regret over the episode and close the matter wisely.
