Difference between Sale Agreement (of land) vs Land Registration vs Land Mutation.

Dear Sir/Madam,

Can you please explain me the difference between these three? And which one of these is the most legally binding document?

Sale agreement only an agreement for consideration.after that the title passes when registration is made in sub registrar office .from seller to purchaser. After that purchaser has to mutatethe land to his name.

Agreement to sell; Generically speaking valid for 3 years to approach court to press for sale deed………..However refer to T&C as in the agreement..

Agreement to sell is not sale deed and insufficient to transfer the title..


Land registration; by a valid/registered deed e.g; sale deed is valid instrument to transfer the title..

IT is legally binding (as term used by you in query)..

Mutations; after Land registration; by a valid/registered deed e.g; sale deed…..is to update the mutations record for which the O/o jurisdictional authority say; MC may ask for copy of say; sale deed…as link document..

Mutation reords has to have all link docs..

For details go thru; Transfer of Property Act, Registration Act and LOCAL rules of O/o jurisdictional authority..

Online discussions are not substitute to in person discussions with a very able counsel of unshakable repute and integrity specializing in concerned field of law.

There are such very able counsels at each location.

Check for such counsels at LOCAL e.g;, O/o Tehsildar, Revenue/Civil courts, HC, SC …

You can also try to get free legal advice from FREE Legal Aid that is usually in LOCAL courts Complex..
