मान्यवर, सविनय निवेदन है कि मैं सलिल कुमार पटेल, टीजीटी गणित, मुकुलारण्याम इंग्लिश स्कूल, सिगरा, वाराणसी का पूर्व कर्मचारी हूँ। मैं आपके संज्ञान में निम्न तथ्य लाना चाहता हूँ – 1. मुझे केवल मौखिक रूप से प्रधानाचार्य द्वारा बताया गया कि एक महिला सहकर्मी ने मेरे संदेशों के संबंध में शिकायत की है। 2. परंतु मुझे न तो शिकायत की लिखित प्रति दिखाई गई और न ही आंतरिक शिकायत समिति (ICC) द्वारा किसी भी प्रकार की पूछताछ या सुनवाई हेतु बुलाया गया। 3. POSH अधिनियम के अनुसार, शिकायतकर्ता और प्रतिवादी दोनों को सुनना अनिवार्य है, किंतु मेरे मामले में यह प्रक्रिया बिल्कुल भी पालन नहीं की गई। 4. विद्यालय प्रबंधन ने बिना किसी निष्पक्ष जाँच और बिना मुझे सुने, मेरी सेवाएँ समाप्त कर दीं। 5. अब संबंधित शिकायतकर्ता ने भी विद्यालय से स्वेच्छा से त्यागपत्र दे दिया है, अतः शिकायत का आधार ही समाप्त हो चुका है। अतः, मेरा विनम्र निवेदन है कि – 1. मेरे विरुद्ध की गई कार्यवाही को अनुचित एवं अवैधानिक घोषित किया जाए। 2. विद्यालय प्रबंधन को निर्देशित किया जाए कि मुझे मेरी नौकरी में पुनः बहाल (reinstate) किया जाए। 3. मेरा मुख्य उद्देश्य compensation या damages लेना नहीं है, बल्कि केवल अपनी सेवा (job) को वापस पाना है। मैं समिति को पूर्ण सहयोग का आश्वासन देता हूँ तथा समिति के सभी निर्देशों का सम्मान करूंगा।

To appeal an Internal Complaints Committee (ICC) order under the POSH Act in India for a false case, you must file a representation to the concerned appellate authority, which depends on your service rules or employment category, within 90 days of the ICC's recommendation. 
The grounds for appeal can include perceived bias, procedural flaws, non-compliance with the PoSH process, or findings based on insufficient evidence. 
 
If you are a permanent employee covered by the Central Civil Services (Classification, Control and Appeal) Rules, 1965, your appeal first goes to the Disciplinary Authority.
 
If you are not under these rules, the Industrial Employment (Standing Orders) Act, 1946 often applies, and the appeal typically goes to the industrial tribunal or the labour court.
Your appeal should clearly outline why you disagree with the ICC's findings or process.
You can state that the investigation or decision-making was biased against you. 
You can also mention that the principles of natural justice were not followed, or the PoSH process was not adequately followed.
You may mention that ICC's findings were based on a lack of evidence or non-application of mind to the evidence presented. 
When appealing a finding that implies a false complaint, you can argue that Malicious intent has to be established after an inquiry. 
A mere inability to substantiate a complaint is not enough to be considered a false accusation.

केवल यह तथ्य कि शिकायत जॉड से बाहर हो गई है, शिकायत को कम नहीं करता। इससे शिकायत का आधार समाप्त नहीं होता।

आपने कहा है कि आपको बिना किसी प्रक्रिया का पालन किए बर्खास्त कर दिया गया। इसे चुनौती दी जा सकती थी।

आपके प्रश्न में इस बात का बिल्कुल भी उल्लेख नहीं है कि मामला कितना पुराना है। इसलिए ऐसी कार्रवाई की व्यवहार्यता पर कोई ठोस राय नहीं बनाई जा सकती।

You can approach the competent court/Tribunal if your services have been terminated without following the due process.

You may also seek damages/compensation if trhe complaint is really false. 

However, resignation of the complainant is of no consequences in the given facts.
