Would wishing wife on diwali be considered mental curelty
divorce and 498a in court
would reminding wife of previous diwali , sending snap of how couple where when they where togther amount to mental cruelty, would it impact AB which i have got.

these are all perceptions. Unless we see the full text of the wishings,one cannot comment on it.
and what was the need of such wishings at this juncture?

such steps do not constitute mental cruelty...rather in my opinion it must be considered as your initiative to compromise the matter with her...
but it is advised to control your emotions...better would be to involve other relatives in the process to calm down the situation...

If the same is not in taunting way and does convey 'missing you',in law it shall not constitute CRUELTY OF ANY KIND,BUT HOW SHE WILL TAKE UP IS KNOWN EITHER TO HER ALONE OR ONLY YOU CAN GUESS.
Hence it is prudent to hold emotions as advised.

text would be simple
wish you happy diwali nothing more
intention is remind her, how wonderfull life we had when we were togther last diwali
we never had any fight till she was her, her mother was forcing me to stay with their family which i refused. then start the series of allegation
first abt my parents, then me, before we know, 498a and divorce petioin was filed. After that i did not have communicatioin with her,,,
I am waiting for chargesheet to happen, so i atleast make an attempt prove truth in court..
I still dont know why i getting divorce and cannot dare to call or talk to her due to fear of police and court.

Beautiful answers to a beautiful question. A person facing 498a & divorce wishes happy diwali to his wife and the wife thinks of slapping another charge coz of this situation. Hahaha, Dude dont you think you are bit late. But no worries its the charge against you, you have to ease the situation the way you think. I wish you a very very Happy Diwali for these feelings & Emotions !!!
