Dear Mr. Rajkumar, I think you are talking about the decision of the Supreme Court in Suraj Lamp & Industries (P)Ltd. vs State Of Haryana & Anr. on 11 October, 2011.

Please note that decision did not say that a GPA authorising the sale of Land cannot be registered.

All that the judgment said (in fact reiterated the existing legal position) was the practice of transferring the property by means of Agreement to Sell coupled with GPA/SPA + WILL without payment of stamp duty cannot convey proper title to the purchaser.

The said judgment nowhere said that one cannot constitute a GPA/SPA for the specific purpose of sale of one's property.

BUT LARGELY THE IMPORT OF THE SAID S.C. JUDGMENT HAS BEEN MISUNDERSTOOD NOT ONLY BY THE GENERAL PUBLIC, BUT ALSO BY THE LEGAL COMMUNITY AND ALSO BY THE ADMINISTRATORS, causing all round difficulties and wrong advices.

Now Mr. Bindal is only asking whether there are any Advocates who can help him in getting the GPA for Sale of property drafted by him, registered in Banglore.

I agree with Mr. Anirudh. One more difficulty started in U.P.. The Sub Registrars have ordered to register the POA only where the land is situated. This just taking away the basic requirement of POA.

Secondly they are just registering the POA with in the blood relations.

Just without any suitable amendment in law.
