missing of original documents

Sir I am Sharmila we are having issues on our Fathers Property my father died three years ago and my mom sister and me are the legal hiers. My sister has taken the original documents what should I do legally what can she do using the originals

If you know the property details, you can obtain certified copies from the concerned sub-registrar office. Since the documents are in the name of your father and he is deceased, though originals are with your sister, she can not deal with the property on her own. It is a family matter. Try to settle amicably. Otherwise file suit for partition. What is the stand your mother?

You could Contact a Local Good Advocate and Publish the Matters in News Paper To Stop any one to Deal With It.Also as advised by Mr.Malipeddi Jaggarao Apply Copy of Documents and EC Till Date.If you had already Obtained the Legal Heir Certificate File In the Court For Partition.Or First Apply For Legal Heir Certificate and Proceed with the Help of Local Good Advocate.Your Sister would Come For A compromise during the Process.

Get certified copy of the documents from registrar office and proceed to get the mutation in the name of legal heirs.

If your sister has taken away the original papers but has not taken any undue advantage from it......................even then it is undue influence.



Any one of the ClassI legal heirs can even proceed to lodge a complaint against her.



However she should be made to understand that her actions are unfair and can lead to complaint and a case.



Prior to that if it is suitable to you record an admission by her that she has taken away the original papers and is unwilling to return these.



Yes anyone of you can initiate a partition suite.



Certainly amicable settlement within tolerable limits of time is the best option.
