(Querist) 27 December 2013 This query is : Resolved
Sir,

Following are the details of my case

1) My uncle was legal tenant since 1942
2) He was ask to vacate in the year 1965 since he got alternate accomodation
3) My father has been occupying the house since 1952
4) Landlord does not accept the fact
5) We have exhausted all the legal action and has been asked to vacate the room
5) Can NOC given by landlord for water connection be considered as a proof that landlord has accepted us as a tenant.

you have to comply with court orders . vacate the premises as you have lost the case.

if NOC has been given in your name for water connection you can rely upon said documents in support of your case .

There are more provisions for any tenant to maintain possession than eviction in any rent control act.

However the tenants do not seek expert legal help in the initial stages and when the case is spoiled run for experts.

In your case at what stage the legal case is lost if any further stage is remaining than this evidence can help you.

I am of the same opinion as that of expert Advocate Defense has. whether the said evidence in your hand was not utilised by your advocate in the case at any point?, this seems to be a valid evidence, please consult a prudent lawyer on the subject for further proceedings.
