Hello expert

I am having flat land is on builders name . no society is formed and building is about 20 years old . so my question is if building collapse does i have any right in the land or not
Guest (Expert) 30 June 2016
Mr. Jatin,

What do you mean by flat land?

Also, are you really socially active (as per your profile), as per your profile, when you have kept your own flat in the name of the builder for the last 20 years and not got registered in your name? A novel example of your being totally inactive, in spite your claim to be siocially active!

Since your question seems to be quite hypothetical and of academic nature, nobody would have liked to respond to your question.

Moreover, normally the buildings don't collapse within 20 years.

Not only that your questions are totally contractory from one another. In one question, you state you have flat, while in another you have stated "undivided right in the land beneath the building." What is reality that God knows. So, how do you expect response to your confused question.

However, if you really have some problem, better send scanned copies of your flat related documents, alogwith full description of the problem, to any of the experts here, they will definitely provide you appropriate solution to your problem, as far as possible, otherwise, you should not expect any response to your hypothetical academic query.

My question is simple and it is not academic query . as socially active i have register my flat and all other document related to flat is on my name.
My question is simple we have not formed society and no dody is willing to form. Therefor land is still in the name of landlord, hence i am asking if building collapse do we all flat owner has any right in the land or not. In my sale deed " undivided right in land beneth the building" is mentioned.

As the owner of the flat, you have the right to property in the said land. But how come the question of collapse of the building and the exigencies thereafter?
Guest (Expert) 04 July 2016
In fact, you seems to be putting stress merely on flat and a tiny part of the agreement, whereas interpretation of the whole agreement is quite necessary.

Secondly, you have not made clear how the idea of the collapse of building cropped up in your mind.

Better show your papers to some property expert to ascertain about your right on collapse of building.

Thanks expert for your prompt reply. Thr question of collapse of building came in my mind because my building has crossed 20 years and now all plaster is coming out and in some place bars are also visible all flat owner are not getting ready to do maintenance. Hence i was anxious to know that if building collapse what will happened. Because our building is not register as society.
