A permanent Government servant appointed in another Central Government Department/Office/ State Government, has to resign from his parent department unless he reverts to that department within a period of 2 years, or 3 years in unless he exceptional cases. An undertaking to abide by this condition may be taken from him at the time of forwarding of his application to other departments/offices.

T. Kalaiselvan, Advocate (Expert) 06 March 2024
Since it is a technical resignation and you are having lien you can very well resign the present employment and return to the parent department by making a request to the parent department to absorb you back on the basis of the lien you have with them
Querist : Anonymous (Querist) 06 March 2024
my matter is little complicated
T. Kalaiselvan, Advocate (Expert) 09 March 2024
You can better consult a service law practicing lawyer in the local with all relevant information and papers to obtain proper opinion
P. Venu (Expert) 09 March 2024
"my matter is little complicated" How? Please post material facts.
Sudhir Kumar, Advocate (Expert) 25 March 2024
Sin you are on technical resignation with lien you need to state any reasons and just have to exercise your option of going back.

New department and old department have no choice if you opt to go back (before confirmation in new post after which lien will be vacated and you have no claim to the old post.)
