Compassionate grounds job - past 9 years fighting to get job

My dad Mr. D. Chandrasekaran passed on October 2009 and he was working as a O.A in Tamilnadu Housing Board - Mudurai branch.

I have applied to get his job under Compassionate Grounds in TNHB @ December 2009. Till date i haven't get any appointment order in this Housing board department. For the past 9 years I am keep on walking to this head office and writing may pettison's. But they replied back to me as "your application is in process but we didn't have have any opening wright now . will let you know when we have opening".

But TNHB announced "Direct Recruitment 2017" for 300 vacancies and they conduct the exam and going to issue appointment order for those cleared in the Direct Recruitment. However I didn't get any order in Compassionate Grounds - since i am waiting for more than 9 years.

Please suggest me how to get my dad's job whether can we file a case against this "Direct Recruitment 2017" appointments ? Whether can I get my dad's job under Compassionate Grounds in Tamilnadu Housing Board.

Prima-facie it is not your dad's job that you will get. it is only "a job" you could have hoped for.

Compassionate jobs are given only out of 5% of Class III&IV posts (in direct recruitment quota) and comparative merit of the applicants is assessed. Remember reservation beyond 50% is not allowed as per Supreme Court guidelines. The Govt sector jobs are already reserved to the extent of 50% (15 SC+ 27 OBC + 7 ST). Therefore even that 5% is to be taken from the proportionately by vertical reservation from the respective share of Sc/ST/OBC/gen category posts depending upon the category of the applicant. That being the case the share if gen candidate is 5% of 50% = 2.5% out of total Class III&IV posts (in direct recruitment quota) , and OBC it is 5% of 27% = 1.25% out of total Class III&IV posts (in direct recruitment quota) , for SC 5% of 15% = .75% out of total Class III&IV posts (in direct recruitment quota) , and for ST it will be 5% of 7.5% = 38% out of total Class III&IV posts. No job can be offered beyond that limit even if the applicants are large number. The sots reserved for Handicapped, ex-servicemen and sports persons are also allocated in the same manner to ensure that horizontal reservation does not exceed 50%. So comparative merit is drawn based on the indignant condition of each family.

1. When did you apply?
2. whether any appointment has been made in this 5% quota.
3. When direct recruitment was there then why did you not apply for the same.
4. How old are you?
5. Are you married?
6. Are you sitting idle or doing some job?
7. Who are other dependents (including your mother) of your father and what are they doing?
8. When did you apply for this compassionate job.
9. Whether the 300 vacancies belonged to Gp-C&D posts only?

You seem to have as per query applied in time and hope you have acknowledgment of all said petitions.

Do you have copy of 'Compassionate Employment rules' of establishment of year of death of your father and later years ?
If yes post the link or attach......
