Buying a plot

Hello Lawyer's Club
We are planning to purchase a piece of land/ plot recently. Can you please tell us what minute precautions to be taken before going ahead. Thank you.

Please check the Tehsil/Sub-Registrar record of the plot of land that you are looking forward to purchase. The actual ownership status of the immovable property can be checked and confirmed from that office. This will confirm the ownership of the plot of land.
The Municipal Corporation records of the property should also be checked with regard to the person in whose name the property tax if any of property exists in that record.
In case the plot of land is being sold by some builder/coloniser, then check if the person/company selling it has State Government authorisation and the plot of land is free of any dispute/litigation in any Court or government authority, the Deputy Commissioner's office of the District can be contacted to verify this.

You may not be able to buy any property, if you speak about precautions, as you can find only some rare faultless cases of property.
However, several things, like original documents, previous ownership, mutation, encumbrance, testamentary position, litigation, heirship disputes, all may be necessary to be gone through.

Better take help of some very experienced estates consultant for guidance and buy only if you are satisfied about the fairness of deal.

verify the property extract, encumbrance certificate, mother sale deed and verify that how the seller got the property. If it is ancestral property , then sharers consent is must to sell the property. If you satisfied with all the relevant documents then publish in the paper calling for objections from anybody to your purchase.

"Buyer Beware" is well said time tested maxim.
If you are interested in buying a property investing lakhs of rupees you must pay few thousand rupees to a local lawyer for verifying title, encumbrance, previous chain, claim or interest etc.
