Sir i have been living in himachal for last 24 years my father has been living in himachal for last 35 years he has been issued domicile certificate but when i applied for said certificate authorities refused to issue said document we have been residing on rented property for last 30 years i have 10+2 certificate issued by himachal pardesh school education board which i passed in 1994. Can i get bonafide certificate

What is the reason for rejecting your case cited by authorities?

What is the basis of your claim to get domicile of Himachal?

Staying in the state, on rent, do not entitle you for the same.

Which is the authority? You have the option to approach the higher authorities or seek judicial review.

As Per H.P. Govt. O.M. No. 12-7/73/SAD dated 18th Aug. 1972 a certificate can be issued if he fulfills following requirements:

A Bonafide Himachali is a person who has a permanent home in Himachal Pradesh, as also a person who has been residing in Himachal Pradesh for a period not less than 15 years, or a person who has a permanent home in Himachal Pradesh but on account of his occupation is living outside Himachal Pradesh.

Approach higher authority if your request rejected illegally.

If declination is against rules you have a reason to appeal against it.

A non himachali should specifically clarify the purpose of purchase of land under Rule 38 (A) of Himachal Pradesh Tenancy and Land Reform Rules 1975.

Normally construction of Residence Permission up to 500 Sq Mt would be granted with out much objections on valid grounds to non himachalis by concerned depts
