Sale agreement

Sir,
I made an agreement (not registered) in 2006 to sell my land and received a small amount as advance. The period of contract is for 3 months. I approached the purchaser so many times for sale but till date, the purchaser has not come forward for purchase of the land. What is the limitation period for contract? What I can do sir? Kindly advise. What is the legal status of the agreement?

The Period for any agreement to enforce any Legal Remedy it self is 3 years

1. Based on the "period of contract of three months", ISSUE a proper "legal notice" to the purchaser, under proper acknowledgement, to conclude the deal or the deal stands forfeited after 30 days of Notice.

2. Based on such Notice, look around for another purchaser and conclude the deal, without any further reference to the first purchaser. This will be safe & legal, for all purposes.

If you have accepted the money through cheque or bank transfer, then send a legal notice to the purchaser for cancellation of the agreement.

"Time is essence of contract "agreement executed in the year 200,had to be performed within three months from its execution. As per Article 54 of Limitation Act, a suit for specific performance can be filed either expiry of the date mentioned in agreement or within three years of execution of agreement. Now buyer can't take any legal action against you. You are free to sale the questioned land to anyone. Follow the advice of NJS Raj Kumar.
