Pay protection rule in lower scale post.

Respected members,

I am in need of your guidance in the following matter :

I was working in a Central Govt. in Level-7 and drawing basic pay 50,500/-. I have been selected through Direct Recruitment in Level-5 in another central govt department. I have been relieved on 31.08.2016(AN) by my parent department with permission to lien as per govt. rules and now I joined new deptt. on 01.09.2016(FN).

Kindly guide me what will be my protected basic pay and DNI in new department.

If you have applied through proper channel in your Original central Government Department your scale of pay in the new organization will be fully protected.

No purposeful opinion can be formed, as the very basic information is wanting from your description, particularly on your application process for the job, pay scale of level-5 post, and on what ground you have been allowed to retain your lien, etc.

When your department is not ready to protect your pay, how do you propose to impose CAT orders in some other's case on your department, more so when you are not ready to provide the most necessary basic information of your case?

I have applied my resignation through proper channel in my parents central govt department i.e. Enforcement Directorate. Presently i am working in CAG Office in Indian Audit and Accounts department.

Really a matter of surprise, if your department accepted your application to be forwarded for a lower level post, if sent through proper channel.

You have not provided information about the pay scale of your present post, even on asking. Is there any specific reason for not making mention of pay scale on your present post?

Sir, My present pay scale is 29200-92300/- in Level- 5 and old pay scale was 44900-142400/- in Level- 7. My parents department basic pay was 50500/- in Level- 7 as on 31-08-2017. Present department treated as direct appointment and basic pay fix is 29200/-. Please guide me.

Keeping a lien on your job and submitting technical resignation from it (which is yet to be accepted) would protect your pay in same scale i.e., 29200/-.

Your present organisation has fixed your pay as per the provisions of rules. No ambiguity appears. However, if your authorities agree thay can upgade your basic pay by the number of increments in the present scale for the number of years of service you rendered so far.
