I reside in a rented flat in Kolkata withmy wife and son.My wife did not stay with my parents in my native village .Both the over aged person look after them. I have a grudge against my wife's forcefully living with me for about 9 yrs.Recently
At the time of quarrelling at about 12.00 AM with my wife one of our office boy who lives nearby whom I suspect of being an affair with my wife entered my flat to support my wife and beated me badly with the help of his brothers.My wife is frequent visitor of their house.Wife called him.
I don't want to stay with such wife with any more who organised such event.Is there any way???

Along with the Precise advise of Expert/Advocate Mr.Yogen Kakade Also File A Police Complaint about the Culprit who entered your house along with other Goondas.Obtain FIR from Police which would be helpful in Divorce and avoid stating you were having a Quarrel with your Wife that time.If Your wife says so you could Deny stating it is a self made story.

If you were beaten badly you could have lodged police complaint.
Henceforth if possible, keep your near and dear and trusted ones, near your place of residence for your help and witness.

IRRESPECTIVE OF YOUR FAULT WHICH WHETHER AT ALL OCCURS OR NOT.
you are entitled to file criminal case of beating against the said outsider(s).
This alone is however not a ground for divorce. This will compel your wife to come as witness to say that she was rescued by them on humanitarian grounds.
if reasonable material is there for proving adultery you can file divorce.

You should have lodged FIR against the outsiders who attacked you in your house.
You seem to have no sufficient reasons to file divorce till you gather solid proofs of adulatory against your wife. May engage some spy agency to gather proofs.

Counselling to an agreed lawyer failed. She firmly informed the lawyer that she will never disconnect the relationship of that person and his family. It was my first condition.Being my son a part of our family I demanded the power to access the child as she can. If she can take him to her parents I too be able to take my son to my parents but in vain . For the fear of being a victim of DV case I am now started living separately though given Rs.12,455/- for expense for March'17.Still She has used the Credit card kept with her for Spencer bill Rs.1400/- only the other day.In the past I paid very little to my parent if they claim in the court then I will be in a fix to meet the maintenance to my wife. My take home salary is rs.34,577/-. How much compensation she may be awarded????

Dear Sir/Madam,
On 7th My Father-in-law called me politely for a solution but it was a trap as soon as I reached there they called their henchmen and I was tortured mentally to obey their demand and sign a document written hundreds of allegation. I refused to do so and agreed to go to a Lawyer for counselling.But on 10th the counselling failed. From then on I never go to that flat,living separately. Now the lawyer informed that they want to sit again. But seeing the list of allegation I was shocked and decided at any cost not to carry on this relationship further.
The lawyer warned me that I am in the back foot as my son is reading in Good school maintenance may be 1/2 of my take home salary.
Then how will I maintain my over aged parents living the native place helplessly.They educated me in-spite a lot of poverty.What will happen if they claim a maintenance in this stage??
Please answer. I am in a great tension
