Respected Experts, request your guidance in the below two queries
1) can two witnesses have identical statements. (looks like police did a copy paste job editing only the name part)
2) Can legal notice be used a an evidence. I am having a legal notice in which many things contradict with the FIR.

1. Does the statement before court is also identical? Has the same been crossed by the defense?

2. Accused can submit documents in his defense.

Respected Experts,
Below is the brief case history.
I was recently accused in a frivolous 498a case coupled with 504, 506(2), 114 and DP act 3 and 7. Joyfully was able to secure bail for Myself and family. Upon inspection of documents, it was identified that statements of witnesses was exactly identical. I understand that no two people can reproduce the event exactly the same. It looks that the police had ready format and done only a copy paste job.

My wife deserted me and refused to come back. At such I sent a legal notice as I also had a daughter. All the attempts for amicable settlement were in vain. In return she replied to my legal notice refusing to join back and filed the fake case. There are many details in the notice which contradict the details in FIR.

Despite the clarifications given by you, still there are missing links to your statement/query, hence cannot make out proper case and opinion.

What is the opinion and advise of your lawyer who has processed your bail "joyfully"?

Why do you seek second advise of experts on this platform except the fact it is FREE OF COST.

However, if you have lost faith in your advocate, change him/her immediately and engage/discuss/consult the question with some other prudent/senior local lawyer.
Rajendra K Goyal (Expert) 19 January 2017
May proceed as advised by the expert Dr J C Vashista.

Agreed with expert Dr J C Vashista.
