Non Registration of Birth

Dear Colleagues

My Date of birth is of September 1989 in Peth Taluka, Nashik which requires compulsory birth certificate for Passport.

Now coming to the issue I have visited various government officials in Peth Taluka and after several efforts I have found Nagarkar Panchayat office of Peth doing this work, I have applied in prescribed format along with all relevant document like LC,Pan etc. that official refuse to give me the certificate because they lost the record of 1989 and morever gave me endorsed that your birth entry not found in record.


Now please suggest how I should go forward with this

In your 10 th class certificate your Date of birth may have been mentioned. Actual birth certificate is also issued by Registrar of births and deaths Municipal corporation on submission of notarized
affidavit by your parents. and you. Or you've been delivered in a Hospital the hospital Authorities would issue your date o Birth certificate.If you appreciate this answer Please click the thank you button on my profile.

If you have other documentary evidence like SSC certificate, non-submission of birth certificate issued by Municipal Authorities should not come in your way for issuing the passport. You and your parents can submit Notarized affidavit. Better contact the Passport issue authority and seek their guidance. Nowadays they are very friendly.

Whether your birth was registered by the concerned Registrar, if so apply, pay required fee and get the copies.

If not registered, obtain the permission of the competent Magistrate for getting late registration of the birth, get it registered and get certificate.

section 13 (3) Any birth or death which has not been registered within one year of its occurrence, shall be registered only on an order of Executive Magistrate of respective area, and on payment of a late
fee of rupees ten.

Dear Colleagues

I appreciate your prompt reply but my actual query lies in your ans because I have all relevant documents to prove place and date of birth but Nagarpanchyat Office have lost the records of that year morever the Hospital also denying the responsibility by saying that annual record has been sent them by regularly and they need not to maintained now. My query what is the procedure from getting it through magistrate because they also denying the affidavit. And the mistake is not from my side so how can give the affidavit that birth was registered.

You can take court orders to accept your documents and issue birth certificate accordingly. It may be a bit lengthy process.

Or you may proceed to re-register the birth as record is not available by getting permission from competent authority.

Or entry is not found because the record is lost!

You can adopt the procedure laid down for late registration of birth on the basis of this certificate.
