(Querist) 24 September 2016 This query is : Resolved
My question is under Hindu succession act property of female or right of female in ancestor property is one of the same thing?

For example Mr A died without any will having a one house property. Mr. A has only 2 daughters i. e. B and C. C is also pass away withot will she have a 1 daughter and her husband as a legal heair.

Now Mr. A's property how divided between his 2 daughter one of them is died?

How are you related with this matter!
Ritesh Rathod (Querist) 24 September 2016
I want to purchase this house property
Kumar Doab (Expert) 24 September 2016
You have confirmed the deceased owner was Hindu.

It is believed that it was self acquired property.

The ClassI legal heirs i.e. mother, wife, sons, daughters shall share equally.

The share of married daughters shall devolve upon her sons or daughters.

Prefer proper legal opinion from a very able counsel.

I endorse the advice of Mr.Kumar Doab.

Sir in short i just want to know that share of wife in her parental house will distributes to her children only or her husband can also claim a his share? Thanks professional.

Mr. Ritesh,

In short, as a student, your query is purely an academic question for which my advice is that you should rely on your course materials, if you really want to gain knowledge of law for your career sake. Only after forming your own views based on your study material, if doubt still persists, you can come to this forum.

Otherwise, if you seek 100% spoon feeding, that would be just a cosmetic, artificial or skewed knowledge for you.

Best of luck!

If you have no relation with the contents of the query then why should we oblige you in this particular section.

Why don't move to appropriate section of this particular site despite of advice?

Belong to Hindu. Your co operation is expected sir. Thanks

Your subsequently posted facts are not properly drafted. Please put in small sentences giving complete sense.

Mr. Ritesh,

What a non-sensical clarification.

Being a student (as per your own profile), how any one can believe that you have such a hefty earning that you have the capacity to buy a house for your father?

Before making such an idiotic clarification, you could well have seen, what introduction you have given for yourself in your profile page.
Rajendra K Goyal (Expert) 01 October 2016
If you want to buy the property, show all documents to your lawyer and get his opinion. Lawyers fee would be negligible compared to the value of property.

Casual query / reply without referring the documents may not solve the problem.
Ritesh Rathod (Querist) 05 October 2016
Mr dhingra i updated my profile now i think you may help me out by your great deep knowledge.
Sir i refer the docs to 2 lawyer but unfortunately both give me a different opinions.
Mr. Raj kumar plz sir you just atlest once refer my first main querry i think it might be not ambiguous.
Thanks professionals.

The property that devolves by inheritance is of nature; self acquired.
In case of Hindu woman the nature and source of property matters.
In case of self acquired/absolute property; the 1st right for equal share if of; Husband(if alive as on date of death), sons and daughters….
