Hobble experts. , in law process 138 N I A. the accused is required to b. examined and cross examine d , or he has to answer the proceedings which R asked by the judge ( sec I m not remembering )

Sir ,
My second need is to know , that I have sent a legal demand notice to accused under sec ,138 ,Of NIA , and now 15 days crossed with no answer from accused. And No Payment from him .
So when the time limit will end to procecute the accused . ? That is after three year ? As at present I have some constrains to appear in court on hearings .

Is it not your academic query, as that does not contain the case history?

When your second requirement has not yet riped, the case is still at notice stage, where is the relevance of your first query through which you want to know about the process of examination and cross-examination of accused.

If there is any truth in your case, at first hire a capable lawyer, file a case u/s 138. Your lawyer will take care of the rest of the process about exaination/cross-examination, etc.

Kindly only guide me , that whether I will be able to lodge a complaint after about SIX month .? Where as legal demand notice sent by me to accused was served on him on 3/8/16 . So in this eventuality would the prosecution under NIA ,( sec. 138 ) b admitted to try and decide
Kindly guide . OR It would B rejected as Time Bar .,?
