Wife suffering from mental illness 'Dissociative Disorder:Not Otherwise Specified'

Can this disease become ground for divorce ?

Mere mental disorder itself is not a ground for divorce.If the same causes instances of mental cruelty then only it can be ground of divorce.

1) Since marriage we were observing physical problems. Excessive chills without fever, yawning. Intermittently. When contacted family physician used to find everything normal.

These symptoms openly came out after 5 yrs of marriage.(Jun'2006) Once she went to perform 'pooja of wad tree' on the day of "Vat Pournima".
She started behaving as if possessedby a spirit. She started behaving as a Muslim man."Rafeeq".

2) She was attacking us. Trying to injure herself. Says "Main ise maar dunga aur is se shadi banaunga" .
We were shocked with her behavior.

3) Since then such episodes continued IIntermittently.
4) Taking psychiatric treatment since then.
5) Apart from medical science, tryingf faith healers, Temples, Dargahs.
6)in between the names of spirits and her behaviour is changing as per that personality/character. The names are- Rafeeq, Amar, Rakhmabai and now its Raja.
7) In a span of a year this continues for almost 8-9 months.
8) very unpredictable, dangerous.
9) Have taken psychiatric t reatment from Noble Hospital, Sasoon Hosp, Govt. Mental Hospital, Senior psychiatrist of Poona Hospital and much more.
10) Apart from this faced interventions , allegation s from In-Laws.I had to approach family court & i had filed case u/s section 9 in yr.2009.

I have noted most problem regarding Marriage Act are personal problem and not legal problem.

Your problem it seems is adjusting with chronic & acute psychiatric department case.

Proper person how to cope up with your problem can be guided by only Professional Psychiatric and how to deal with your wife, because such professional have seen hundreds of case we are looking 1 case and that too our knowledge after telling diagnosis is restricted to general reading of wikipedia .

Divorce with Mutual consent is comparatively easy in court but contested divorce where one party is not ready can go very long some time and that too becomes another sort of mental harassment in such situation.

Sorry not competent to say any thing on this issue may be how to deal with your wife Psychiatric can help you and regarding future of marriage it is better all parties concerning (including wife parents) first mutually decide and then only take necessary steps under Marriage Act in Court.

The problem has commenced more than 5 years after marriage and from the facts given, the cure is in compassion from the husband than from the courts of law.

What is the relevance in approaching the Court of Restitution of Conjugal Rights?

1) I think this problem is since before marriage. Some sort of mental problem. Which her father is well aware of and hid to us.
2) That is why he was always opposing the psychiatric treatment.
And was diverting us to Faith healers.
3) when we opposed that way, he registerd complain in "mahila aayog".where this was debated. I came to know he had lodged complain that we were harrasing the girl for money ! He also pressurised me to stay apart from my family.

Hence, afterthat I had approached family court & filed case u/s 9. In aug'09.

4) the case is closed within 2 months.I.e.in oct'09

5) but, till now the problem is not resolved.her dissociative behaviour is continued intermittently.

How to come out of this problem?
