Need to take custody of a person against whom nbw is issued

Hello Sir,
With the forums help I have been able to assist my friend in her matter of cheating done to her.

The accused has a NBW issued by the court in another matter, he wil be bought to Karnataka from his current place of residence Mumbai.

We want his custody to be taken later by local station where we have filed a FIR under Sec420 and others, against the accused.

Could anyone suggest the way to take custody of the said accused.

1-Do I need a Body warrant to take custody of the accused.
2-How do I get the same.
3-Can police issue it or I need to go to the court.

Who are you take take custody?
The police takes custody of the undertrial.
You ahve done enough for the ftiend and now let her/him handle the situation.

Police would take custody of the accused, inform the whereabouts of the accused to police.

What about the BODY WARRANT, we cannot get that to get him to our local station.

As the court has issued the NBW against the accused, it is the duty of the police to comply with the orders of NBW by the court. Here police has to trace the accused and arrest him and produce before the court along with a report on the given day of next hearing. If it is not done on the given date, police may request for further time from the magistrate and since then NBW would be in pending.

If complainant/you knows the whereabouts of the accused she can tell the same to the police or complainant/you can assist the police to go with them to catch hold the accused where he is residing at outstation.

For all purposes, it is better to contact local lawyer to deal with the matter.
