Hi,
Just wanted to check the law about gang rape case with 16 yrs old girl. Actually, the girl is in prostitution business since she was 13 years old. There are more than 100 people who were arrested in this case. I was one of them who got arrested by police based on the phone call made with the woman who provided the girl to many people. It's human trafficking case. Will I be considered an accused person in this case?

Without seeing the FIR it is difficult to advise.A prostitute can very well file rape case.

On the basis of the facts mentioned it can be advisable that you find a good criminal lawyer for your defense. Even if the girl is in flesh trade.. do you really mean the case is of gang rape committed by 100 people????????

It is quite unbelievable, in the human trafficking case, if you were allowed to talk to the girl on phone by the trafficker?
Anyway, please clarify the following points:
1) For what purpose did you make a call to that girl in prostitution business?
2) What were the topic of your discussion with her?
3) On which date you were arrested and whether you are still in police or judicial custody?

Since you have made a phone call and you are saying that the girl is in the profession of prostitution singe the age of 13 years, gives enough scope that you have intimacy with her for quite a long time. Hence, you are advised to consult a criminal lawyer to deal with the case.
