RESPECTED EXPERTS, I HAVE A QUERY...! MY MOTHER HAS CLAIMED HER SHARE FROM HER BROTHERS IN ANCESTRAL PROPERTY (4 BOROTHERS 4 SISTERS)MY MOTHER IS 5 TH SISTER REST OF THE SISTERS HAVE RELINQUISHED THEIR RESPECTIVE SHARE IN FAVOUR OF 4 BROTHERS,INITIALLY WE CLAIMED FOR 1\9 SHARE BUT I HAVE BEEN TOLD THAT SINCE THE DEED OF RELINQUISHMENT OF RIGHTS BY THE SISTERS HAS BEEN MADE ONLY AFTER MY SUIT FOR (1/9 SHARE )CLAIM SO PROBABLY NOW I COULD CLAIM FOR 1/5 SHARE INSTED OF 1/9 SHARE, IS THERE ANY LAW REGARDING THIS OR ANY LANDMARK DECISION,KINDLY THROW SOME LIGHT OVER THIS.

It is felt that the share will remain same.
The sisters have relinquished their share in favor of brothers and it has no impact on share on your mother.

If your sisters have relinquished their shares in the property,then their shares will automatically devolve on other co-sharers equally, therefore you are right that you will be eligible for 1/5th share in the property.
