Dear sir/madam
I am selected as postal assistant in aska division of odisha circle and i was intimented about it by a letter from postal dept for 2013-14 recruitment. In that letter it was mentioned that i am provisionally selected for that post and my appointment is subjected to successful completion of preappointment formalities like document verification, caste certificate verification, police verification and they also mentioned to produce a good health certificate from chief division medical officer at the time of document verification. I went to my division office on the day they mentioned in that letter and produced all the required documents. My verification procedure took a time period of two months. After successfully verification of all required formalities a letter was issued to me for starting inhouse training at my division headquarter for two weeks from 23-04-2015 to 5-5-2015. During my training period a letter was issued by postal directorate to keep in abeyance on issuing joining and training letter of newly recruited candidates on 27-04-2015. After completion of my inhouse training i came to know about this order and my office did not give me joining. I filled rti to know the reason of abeyance but the reply was its material form is not available. I waited thinking it will be settled but now i see uncertainity in its settlement and no one giving me and all the suffering candidates proper reason behind this abeyance.
Kindly go through the situation and kindly suggest me what legal steps can i take to get my joining and to know the reason of this abeyance and its settlement period. Mail id-sahurabikiran5@gmail.com

What do you mean by "I filled rti to know the reason of abeyance but the reply was its material form is not available"?

Sir i filled a rti to know why this abeyance has been made. But in rti reply i got that "the reason behind abeyance is not available in material form"

JUST KEEP ON REMINDING THE OFFICE THAT YOU ARE YET TO GET POSTING LETTER FROM THE DIRECTORATE, THIS SITUATION IS NORMAL , IN SEVERAL CASES IT TAKES ONE FULL YEAR OO.. AS LONG AS THEY DELAY YOUR POST WOULD BE IVEN IS A KIND OF GUARANTEE YOU GET.
IF NOT THEY WOULD SAY NO POSTING WHEN SUCH NO POSTING IS GIVEN YOU CAN MOVE THE HIGH COURT UNDER ART 226 R/W ART 14.
DO NOT GO ON WITH RTI N LIKE...

NEVER HURRY WORKED.
BUT IN THE MEAN YOU ALSO APPEAR FOR OTHER SERVICES EXAMS AND IF QUALIFIED AND GOT A POSTING THEN YOU CAN REJECT THIS POSTAL DEPT POST IN FUTURE.. NEVER SIMPLY BUILD CASTLES IN THE AIR ABT POSTAL DEPARTMENT AS THAT DEPARTMENT IS NOT REALLY DEVELOPING JUST BECAUSE GOVT PERMITTED 'ANGADIA' SERVICES , IE., COURIERS AS A COMPETITOR WHILE THEIR STAFF IS PAID MUCH LOWER SALARIES...SO ONE NEED TO BE CAREFUL TO APPEAR FOR POSTS AND TELEGRAPH JOBS. You can go for appeal of the RTI. Also prey the department to release the appointment as you have completed the training.

You can file an appeal under RTI Act.
The forum for seeking judicial remedy is the Central Administrative Tribunal (in this case, the Cuttack Bench and not the High Court.

Dear balakrishnan sir its very difficult to get a job in this competitive world...i got this job with my hard preparation and i think dept is doing unfair with us. So i posted my query in this webpage. And thanks for your reply i am preparing for other exams too bt at the same time i need a job badly asap.

From given facts it is clear that the RTI request is rightly rejected. You have sought reasons for not releasing appointment. Certainly this information is not in material form and cannot be given.
You could have sought noting and correspondence relating to this decision and not the reasons.
No point in appealing.

Apparently at this stage you have no cause to file case in CAT (as advised above).
Deptt has all the right not to fill a vacancy. They cannot be compelled to fill it. Your cause can lie only when someone junior to you in the merit is appointed.

n one of the multiple threads he gave information that there is a vigilance inquiry on the selection.
You cannot enforce an illegal selection.

Officials are saying the complains of irregularities came from some certain states nd our state is not in that list..nd being a genuine candidate why should not i take help of law. If enquiry is for all candidates why it cnt be proceeded after our joining. And ok they kept our joining in abeyance for enquiring and sorting out fraud candidates. If a candidate found guilty who hv joined department will no doubt be removed and will be pumished, but what if we who were made awaited found genuine. Will we be given compensation. Please clarify if we can demand like this or not.
