Hello distinguished members

After filing complaint u/s 138 NI Act in the court whether the Govt. pleader will prosecute the case or whether the complainant has to appoint his lawyer?

You need to have your lawyer. It is not a case of state vs xxxxx where state pleader will prosecute case.

Is it a private complaint or falling under the provisions of Indian Penal Code, where state should take care?
The very basic preposition of law is to be taught to you, isn't it?
Who so ever has prepared/drafted and submitted/presented the complaint before the Court, exhibited the original documents in pre-summoning evidence and filed the process fees is to proceed, if you have faith in him.

Case U/S 138 NI ACT is a criminal case filed in the trail court where the complainant is represented by his own lawyer.
