Regarding birth certificate

sir,my friends date of birth is 26/12/86.he did not have original birth certificate now he needs of it.what should he do in order to get original certificate.

he have to register his birth through court direction., after that you can get birth certificate..

. birth should be registered at the earliest Every Birth or Death is to be reported and registered within 21 days at the place of its occurrence in the prescribed reporting forms.

Reporting of birth/death for registration after 21 days of occurrence comes under the category of late registration.

Birth and death reported after 21 days but within 30 days of its occurrence can be registered on payment of Rs 2/- as late fee.

Birth and death reported after one month but within one year of its occurrence can be registered only with the written permission of the Registrar on Payment of Rs. 5/-

Birth & death reported after one year of its occurrence can be registered on an order made by the area Magistrate i.e. SDM or the first class Magistrate or a Presidency Magistrate and on payment of late fee.

It is not clear whether the birth was registered or not. If it was not registered, it would need registration first by following delayed registration process.

if it was already registered, apply for certificate.

1. Your friend should be active to get the certificate and not you.
2. He should have approached Registrar of Births & Deaths. If you/ your friend are unable, incompetent or some other difficulty contact, engage and consult a local lawyer.
3. No legal question is involved to be addressed to experts on this platform, it is an unfit query, avoid posting such query.

If the birth was not registered at all till this date, the competent authority will not be able to do it now without a court order, hence approach the local magistrate court with an application seeking direction to the authority to register the same , the procedure is not simple, you may clarify the necessary formalities in this regard from a local advocate and proceed accordingly.
