Validity of stamppaer

Hello,

I have purchased stamppaer of Rs. 46,000/- for registration of a property. My builder has purchased it on my behalf through his lawyer. It was purchased on 26.12.2012. After that he has not register it for property registration. Now after constant followup he told me that Stamp papers validity is expired, I have to buy new stamp papers.

I want to ask that the stamp papers are with me & it has not been used till date. Can i use it now for property registration> If registrar deny to register on that stamp papers, what I can do ?

Please suggest and help me.. I am very tensed.

Validity is till it is executed or used THE STAMP PAPERS DO NOT HAVE ANY EXPIRY PERIOD.

Section 54 of the Indian Stamp Act merely provides that a person possessing a stamp paper for which he has no immediate use (which is not spoiled or rendered unfit or useless), can seek refund of the value thereof by surrendering such stamp paper to the Collector provided it was purchased within the period of six months next preceding the date on which it was so surrendered. The stipulation of the period of six months prescribed in Section 54 is only for the purpose f seeking refund of the value of the unused stamp paper.

In some states the validity for refund is 6 months but theses can be executed at any time.

Instead of posting this query in the forum, go to the concerned Sub Registrar Office and make enquiry. They will guide you as per the prevalent State Law. According to me, time limit is for claiming refund not for execution.
