How can i get the divorce or legal proceeding against my husband

(Querist) 03 March 2015 This query is : Resolved
i filed dowry, dv, threat to life complaints against my husband in police station and to commissioner office of the city, who referred the case to women cell. women cell made a written compromise between us, according to which, i get 4 lakh rupees in advance and i should get 2 lakh at the time of final consent of MCD before the judge. we have also agreed not to take any legal actions against each other and to take all cases back by me but after the divorce. but in petition of the court, before the divorce. we had attached the compromised papers with the petition of MCD. he had already given the first consent before judge. now its the time for final consent. but now he is denying to give the final consent for his some personal reasons(to confirm the quashing of dowry, dv cases although these are simple complaints and not FIR or court cases) and taking the time further again and again for thinking. what should i do to get the divorce. can i do some legal actions against him like the dowry, dv case against him and his family or any other . he is harassing me without any reason again.

if your husband does not attend court at the time of second motion you wont get a divorce . if husband with draws his consent divorce petition would be dismissed . as per consent terms DV and other cases have to be with drawn after divorce . so continue those cases filed by you .

you are at liberty to file fresh divorce case if your MCD is dismissed

Your husband is right to delay the final hearing. You have got more than half of the amount. So withdraw the criminal cases and then go for final hearing. this is how the settlement happens.

You have received major amount of money agreed. Do not withdraw the cases if he does not come for second motion. You can file fresh divorce case if MCD is dismissed, but contested divorce may take time.
