Writ against dismissal

Kindly let me know what is the duration for filing writ against dismissal.
Since the employee will face problems after joining organisation on reinstatement , can petition be filed in court against dismissal for honourable exit on the same date of dismissal and for recovery of all withheld amount.Can compensation be also filed alongwith?

Without appropriate background and the information whether you filed appeal to the departmental appellate authority and what was the outcome of the appeal, you cannot expect the right solution to your problem.

Dismissed after disciplinary enquiry for misconduct.Appeal made to appellate authority but of no avail as the order of dismissal was upheld.

You are too miser in providing the basic necessary information. Mere mention of appeal to the appellate authority is not the background. If you don't have any background in chronological order, definitely this is not your personal problem, rather it can merely be a law studen't academic exercise, which may not be expected to be solved through the experts.

My friend has been dismissed from PSU which is a company registered under the companies act 1956 after chargesheeting and completion of enquiry.He filed appeal to the appellate authority with substantial grounds but was rejected.Kindly suggest the future course of action.Can he appeal before the court to give him an honourable exit as his career will be ruined even if he gets back after winning the case.

The order of CAT can be challenged in high court in writ jurisdiction without unreasonable delay.
