Suit for declaration for agreement null and void

A builder promised to make showroom in a mall and took money from us.

He entered in an agreement to offer possession in 20 months in may 2009.

He kept dilly dallying for several years.

We filed a consumer case as the purchaser is in definition of consumer and it is a continuous cause of action as the floor sold to us is still not constructed.

They were three director and one of the director signed the agreement.

In 2012 they dissmissed the director.

Can this builder file a suit against me for delcaration for agreement as null and void ?

No, they can not and you will get justice in the consumer case itself. Have patience.

The agreement can not held null and void. Consumer forum would decide.

builder cannot file case against you for declaration that agreement is null and void . directors acts for and on behalf of company .
