First agreement not registered

Dear Sirs,

Ours is a registered co-op. soc. in mumbai constructed in 1990. I have purchase a flat from Mr.A (first buyer) in 1996 and paid a stamp duty and got it registered. However, the first agreement between builder and Mr.A is not registered and no stamp duty has been paid on it.

Could I face any problem at the time of conveyance or resell of my flat? If yes, what is the remedy for it?

1. Since you have already made a sale deed and the deed is registered then this is lawfully done and is legal. The earlier agreement was not sale deed but an agreement to sell and hence even if was not registered you will have no problem.

yes you will face problems at time of sale of flat . bank will not sanction any loan as original agreement between builder and Mr A is not stamped and registered .

The chain of documents are incomplete, you may face problem.

Better avoid this property in absence of all back deeds in original.

on the what papers, you have executed sale deed,if that person have not clear and marketable title.
