My son passed SSC in MAR-2007. His DOB & Name is wrongly mentioned in SSC. I approached Board and they told not possible.I also not cared and let it be at that time. But my daughter & son DOB is coming in same year and I want to change it as per certificate issued by the Local govt administration.
I want help from lawyer association to help me and request for suggestion from any one.

Affirm an Affidavit before the Judicial Magistrate and publish in a newspaper.You can also obtain an order from the Judicial Magistrate for direction to the authority. Then submit it with valid documents to the concerned Board for correction of record and issue a fresh one.
If they would not take any step then you can file a petition of Writ of Mandamus in High Court.

If the Board is not cooperating, file suit for directives to Board for correction.

no correction in DOB will be made after period of 2 years by the board unlesss you obtain court orders in this regard

A declaratory suit will be the best option to pray court to pass a decree and judgement declaring the correct date of birth as per the birth certificate and to make amendments to the school/educational certificates accordingly.

The author has not given reply to the clarification sought by expert Mr.Sudhir Kumar. The author says there is wrong in both DOB and name. Generally this does not happen. If both name and DOB is different, it is prima facie construed as a different boy. Let him come with the reply.
