My name NAGAPRASAD,GOVT.EMPOLYEE,My wife has put DVC case against me.SHE hasput dvc,and 498a and maintenence case with false statements.immediately i have filled divorce case.all which she has writen in dvc is fals,i never demand for dowry. she has filled case on total my family members they dont have any link with this matter
pl help me, how much time it will took to come out from DVC?
how much money duduct from salary for maintence to her ? how much time it will take for divorce?
we have 12y son.

To dispose off the case u/sec.498a IPC will take some years.Quantum of maintenance allowance depends on your income and liabilities,you can appeal in District Judges Court against maintenance order. Divorce process is also lengthy will take some years,no specific time.

The PWDV Act cases carry on for some time and mot less than 2-3 years for sure.
The maintenance would vary from 1/3 to 1/5 of your income.

in Mumbai Dv cases take over 5 years to be disposed of . similarly contested divorce cases take over 5 years . you may have to pay 1/3rd of your salary as maintenance

In DV casaes, under section 23 of DV Act, interim mtn can be ordered within 60 days. Full case may take 2-4 years.
498A u need not worry except harassment.
Sum of money for mtn; depends upon your income, her requirements and that of children, if any..
Your action to file Divorce is not advisable, [ UR MISTAKE] It will harm you. It proves you don't want your wife, so her demand for mtn will be passed immediately..

Disposal of DV case may take minimum two years and maximum five years too. 498a also depend on how prosecution moves on,maintenance case will be disposed in a matter of two years, divorce case will drag on for for more than 5 years too.The quantum of maintenance will depend on your income and discretion of court after both sides establish their justifications before court.

You say you have a twelve year old son out of the wedlock and you have regular income as a govt. servant, So, you can not escape maintenance .
It will be advisable to explore possibilities of reunion to close the matter at the earlist.Best of luck.
