Termination of contract for facility services

After providing thirty days notice period ,what are the precautions to be taken by the principal employer to ensure that the contract labour receives all terminal benefits including last month pay.

Retain Labor Consultant/Service Lawyer to handle all such issues.

Although majority of the employers want HR/Admin to handle everything however HR must not meddle into issues that have legal implications................

Your consultant shall provide you need specific solutions.

While making payment of the terminal benefits to the employee please ensure that,you have duly complied with all the statutory benefis without violation of labour laws (such as PF,Gratuity,unpaid leaves accumulated if any as applicable to the employee). You have to obtain a "Full and final settlement letter" to avoid any adverse claims in labour court. Full and final settlement means that, the employee has no claims against the company.

I thank you for your reply. Full and Final settlement letter from the employee will be taken. This will also put the contractor under pressure to settle with the employee for final settlement with the principal employer.
