Change of mothers name in birth certificate of my daughter

Hi,

Even after marriage I want to continue using my maiden name as all my legal documents have my maiden name.

But on my daughter's birth certificate mother's name is my after marriage name.

Now I want to get my daughter's birth certificate changed to have my maiden name on it as mother's name.

Please help me with the process. This is very urgent as to get her passport I need new Birth Certificate

Change of maiden name after marriage is mere usage prevalent in some parts of the country. It is your choice.

It is difficult to change the entries in the Birth Certificate. You may contact the Authority concerned.

Contact the municipal authority, give affidavit that both are the name of mother and in all legal documents maiden name is contained, complete any other required formality.

The querist wants to change the mother's name (not father's name as understood by Mr. Shroff)by substituting her maiden name in place of her name after marriage occurring in the birth certificate of the child. On the issue raised my view is there is no need for the querist to use her maiden name while applying for passport simply because in all her certificates her maiden name appears. She should indicate her married name in the application for the passport and produce her marriage registration certificate to support the change in the name as indicated in the application.

The birth certificate will bear the information which was given at the time of birth. It can be corrected only in case of incorrect information.

The passport will have the father's name and mother's name.

You request / issue a letter to the passport authorities to use your maiden name only. Using the husband name is not a name change. so the passport authorities will accept your request.

The name of mother as registered in the birth and death register held by the competent authority cannot be changed at whims and fancies. Once it is registered on the basis of information furnished at the time of registration, it cannot be changed or altered as and when someone wants to change it. In your issue you want to include your child's name in your passport and you feel that your name in the birth certificate to that of the name given in the passport will differ and contradict. In such an event you may, it is better to get an affidavit duly attested by a magistrate (executive/judicial), stating that both the names are of the same person. Attach this affidavit with the passport application, you will find your problem solved.
