1) My cousin purchased 1 bedroom flat in Kandarpada, Dahisar West, in May 2014. The Society Secretary demanded 60000 Transfer Fee. We had no choice but to pay by cheque issued in Society name. When questioned that the transfer fee should be not more than 25000 he blindly said our Society charges 60000. He refuses to give receipt or show it in my maintenance bill saying they donot have such practice.

2) Membership form with all documents given but we were informed that the share certificate will be endorsed in July 14 during AGM

3) We verbally informed him that we want to give it on rent which he agreed but nothing in writing either from our side or from Society Side. I have received
maintenance bill showing NOC charges for renting the house. Will I have any problem in the future or I can presume since the NOC charges for renting the flat has been shown in the Maintenance bill the problem is over ( My cousin had no idea about this procedure). Police clearance certificate along with copy of registered L & L agreement has been handed over to the secretary which he has accepted. Also original share certificate has been submitted for endorsement but no acknowledgement received.

Please need your guidance.

only after flat is transferred in name of your cousin should he give his flat on leave and licence . wait till AGM is over then only give flat on rent

For any excess charges taken by the society if not returned on notice in writing, registrar should be approached.

Wait for renting and claim till the share is transferred in your cousin name.

It is highly riskful to rent out the property before its transfer and so far as the refund of the excess amount is concerned, society should be served with a legal notice followed with the complaint to the registrar.
