Sir,
My friend has purchased a house which has a shop in Ground floor,Shop at the time of Purchase of property was on rent & there was no dispute on this between the parties. And a new agreement was done between the shopkeeper & Owner.But the shopkeeper never paid rent of shop towards the owner.
Later the shopkeeper filed fake suit of mandatory injunction against the owner that she(my friends mother) is not the owner of said shop & the case is pending before the Court.
Now my query that the shopkeeper has filed an application for repair of the said shop.
Can court permit him to repair the said Shop.
Is there any Judgement which will not allow him to repair my shop as the shopkeeper not only being bad tenant has neither paid the rent and contrary filled a suit claim that the owner of the shop is some one else,

you can oppose application of the tenant . insists that over due rentals be deposited in court pending hearing and final disposal of suit

Oppose the tenants application, request the court to order to deposit the rent in the court first.
