Criminal inquiry

(Querist) 17 May 2014 This query is : Resolved
MR..X purchased plot in the year of 2001 from Mr. y who is the power of attorney is of z. but it was came to knowledge to Mr. x that the said plot was already sold to another person by Mr.. Z in the year of 1977. Then after by the way of search he got the sale deed which was executed by the Mr. z in the year of 1977.
Therefore he lodged criminal inquiry before the judicial magistrate. The said matter was ordered under inquiry of 202.
As per rules police had taken statement of the Mr. x who is complainant and Mr. y who is the power of attorney is of z. and another statement of the Mr. Z also taken.
In the statements of the Mr. y he admitted that he is power of attorney holder of Mr. Z and according to power of attorney he had executed sale deed in favour of Mr. x in the year of 2001.
Mr. z admitted that he executed sale deed in the year 1977 as per his father instructed to sign in sale deed.
But controversy is that police has been written by himself in the statement of complainant that Mr. z and y has not committed any and offence and I do not want to proceed the said inquiry.
The said fact was disclosed when the zerox copy of the statements received by the advocate from the court.
Now what I have to do to proceed the matter because no any compromise taken place and complainant discloses that he do not got to write to police that he does not want to proceed the complain (inquiry)
Pls suggest
Can I lodge complain against the police before superintendent of police that I have not stated to police that I do not want to proceed the complain ?
Can I declare the matter before the court by the way of affidavit that I have not declare this matter.
Please provide judgments of such kind of matter if there are.
Regards

Consult a local lawyer and show him all the papers and case file.
Advocate. Arunagiri (Expert) 17 May 2014
You have to inform the court that you have not given any such statement. If the police gives a false statement, you have every right to file a petition for perjury against that police officer.
Raj Kumar Makkad (Expert) 18 May 2014
It is not so easy as told by Arnagiri. You are required to go in depth of the facts and law concerned with the issue and consult even locally with the senior lawyer and only then move ahead.
