Small rubber plantation labour issue (kerala)

Dear Sir, I have 3 Acres of rubber plantation in Kerala and I appointed a labour for tapping the rubbers. I do not have any written contract with him. He is working per day scale. Now he is not do his job properly and he is demanding huge amount as end of service benefit. He is also threatening me that he will not allow anyone to work in my plantaion.

1. Is he entitled for Any end of service benefit. If yes how much for an year?
2. What is the legal prceeding to face his treatening and employ another man.

Advice from Keralite lawyers highly appreciated.

you have to pay him minimum wages for labourers working in rubber plantations as notified by kerala govt for plantations

if labourer is threatening you then lodge police complaint against him . you are free to employ another labourer .

If you are threatened, you can can legal action. However, the issue has other dimensions. The issue requires careful and tactful handling.

the minimum wages for plantation workers and other benefits including terminal benefits have been notified by the Kerala State government and is available in their web sites, you may browse through the same for on the spot information.

I have searched the website lc.kerala.gov.in but it have the details of minimum wages only, NO Details about ESB. If you know the website please provide a link to me. Thanks in advance.
