(Querist) 01 February 2014 This query is : Resolved
My passport was deposited with a session court against court's order.
After five years i could not remember that it was with court and lodged a police general diary and got a fresh passport issued.
i have never travelled with new passport.
but now after 2 years while going through the case documents i found that old passport is with court.
Not to leave country without informing court and court leave.
Matter pending disposal.
Old passport has expired in2012.
New passport issued in 2010.
I have never traveled on the new duplicate passport.
My ex staff blackmailing me.
I want to inform the passport authority but lawyers says that i will be prosecuted.
I am a senior citizen and have beeb on anti-depressants for last 20 years.
How shall i go about it.

What is the expiry date of one submitted in court and what is the case status is it still pending or over.If the case is over and the old passport had got already expired you need not worry about it .

When a pass port is deposited in a court relating to a case, I do not believe that you have forgotten and applied for duplicate Pass Port. It is a story.
But however, if the old pass port came in your hands after closure of the case, and if it is expired already, you can forget about it and live peacefully. As you are not planning for travel, keep quiet until at least one is expired. Anyway, holding two valid pass ports at one time invites prosecution.

You are speaking as if you are innocent. How can you forget about your deposit of the passport in the court and get a fresh one.

You are liable to be prosecuted for obtaining a fresh passport, by suppressing the fact.

Try the best and get the court case disposed at the earliest.Handle the black mailer in a suitable ways.once the court case gets over you need not worry. What ever happened is happened do not worry and if any issue arises consult a good lawyer and defend accordingly do not volunteer things.Just relax

if your case is till pending in court and you are victim of blackmail tactics deposit new passport lying in your possession in court . the fact that you deposited it on your own in court and confessed to mistake made by you will be considered by the court in case any prosecution is launched against you

I do agree with the experts.

Your intentional wrong-doing is now double edged game.
If you surrender the pass port to pass port authorities, they may initiate prosecution.

If you surrender in the court during pendency of the case, it will be an evidence against your own case.

At this stage, better have a talk with the black-mailer and resolve the matter at least temporarily until your case is over.

Legally obtaining anew passport while there was a valid passport already existing in your name is an offence relating to the suppression of facts material to issuance of passport. However, better late than never, surrender the new passport to the passport authority with an affidavit statement narrating the circumstance that led to application for new passport, since it is your voluntary approach and also being a senior citizen, suffering old age ailments and that hyou have not traveled abroad using the new passport, your case may be considered with a fine amount, for disposal.
