Is stamp duty applicable on flats reserved by government

If there is a building constructed, wherein the entire ground floor is reserved for government use/purpose as per the Approved Plan of the building, then in such case will stamp duty be applicable on such flats/shops. This building falls under Kalyan-Dombivali Municipal Corporation (KDMC) and the ground floor is also reserved for KDMC.

Right now the flats/shops are not transferred, so they are UNSOLD. I am asking this query because, we want to do the conveyance of the land to the Society, for which stamp duty on all flats/shops is required to be paid.

Can the experts please tell me the relevant section no of the Bombay Stamp Act

you can approach local Sub-registrar office and get it personally.

You have been advised by Expert Mr.Ajay Sethi that the stamp duty would be applicable, why dont you clarify the same from the concerned office if you do not want to believe an expert's opinion.

Thank you Ajay Sethi. Your answer was really helpful.

I am a junior advocate working in a law firm. This question was raised by my boss to me and the other juniors. Thanks to you, I was the first one to give the correct answer. Of course we later confirmed it with the Registrar Office.

And no thanks to those other experts, who did not know the answer, but thought it was smart to direct me to the Registrar and the Bombay Stamp Act.

Regn apply to all properties, so also stamp duty and registration....

Under the The Bombay Stamp Act, 1958 , the Schedule I of the act states in detail the
Stamp Duty On various Instruments .there are no exceptions to any instruments.
