Sale of minor property by father (guardian)

(Querist) 20 November 2013 This query is : Resolved
I had bought one acre of land under my two sons name half acre each. I want to sell the land whatever money i get from the sale i will open an account under their name and use these money for their education.

my question.

Why should i need permission from the DJ.

When i am taking (sale proceeds) checks under the minor name using this amount for their education.

There is no answer to word why as you have asked.

Law requires permission of the court for the sale of immovable property owned by minor so you shall have to follow it.

Any property belonging to minor or if there is any minor interest in the property, though father is a natural guardian and he disposes the same for the benefit of minor, he still needs to obtain prior permission from the District court by filing a petition and can proceed only after obtaining the said permission.

DJ's permission is required for selling minor's property. It will take 1 year for Metro property because of huge load on the Court.
Raghu ponnala (Querist) 21 November 2013
Is it 18 years of age considered a major my sons age is 17 years it better for me to wait until they become major instead of going to court. Any way it going take the same time.

Any way according to me it is stupid law that we have to take the permission from the court it has to changed by u lawyers. Because no mother or Father of the child will make a bad decision by sell the property.

OK WELL DO U THINK BY GOING AND GETTING PERMISSION FROM DJ AND SELLING THE MINOR PROPERTY WILL HELP OR PROTECT THE MINOR. HOW COME THE DJ DECIDE TO TAKE A DISSENSION BASED ON THE PETITION WE FILE IT IS SO STUPID WE ALL AS TO FOLLOW.

Mr.Raghu - No law is stupid. There are so many stupids in the world to misuse it. Hence law takes certain safe-guards. It might not be literally applicable in your case. Laws are made in the larger interest of all and not in the interest of limited people.
