Pension related

Sir,

My father was working for Air India as Engineer, he passed away a year back.

As pension nominee my father mentioned his sister name (my aunt), she is now married and no more dependent on my father pension. For my mother to get the pension do we need to have a NOC letter from my aunt because we are not in talking terms.

Please help me how can we sort this problem,where and who to approach and what should be done.

Was she getting any pension after death of your father? I don't think she would have been eligible for family pension on death of your father.

No sir as far I know she didn't get any pension after dad's death.

No NOC is required from anyone. That is the sole right of the widow (not divorcee) of the deceased.

Apply to company to get Pension. Contact Welfare Officer/ Personnel Mgr/ Employee's Union to do needful so that WIDOW of Employee get Pension.
It is Legal Right of your Mother.
Nomination might hv been filed when your father was unmarried. & not corrected thereafter when he hv Wife/ family.
Talk personally to employer, as otherwise it do not attract interest[ in PF, it attract interest till next 3 years, but not in Pension] So delay means you loose.

nomination is ab-inito invalid. Male employee cannot exude wife from pension scheme (unless judicially separated/divorced) and certainly cannot nominate sister.

I am thankful for all the support. Finally all the paper work has been done and she will be receiving pension soon.

I have one more query.

Will she be eligible to get arrears as dad passed away in Oct 2012.

If yes please let me know the procedure.

She is also eligible to get arrears of pay till the date of death (including the day of death). She may apply on simple paper.
