Ancestral farm

(Querist) 28 June 2013 This query is : Resolved
I am planning to buy a farm from a single owner (xx). The current owner(xx) had bought the farm from its previous owner(yy) in 1985. The agreement that happened between these two parties has a mention that the farm was ancestral. Could there be legal complications after buying this farm if any one from previous owner (yy) raises any concern or leagal battle.

If it is ancestral then the no single legal heir can transfer the same keeping the others out of it.
Take NOC from other legal heirs if any.

The property was ancestral in the hands of previous owner to your owner who sold it in 1985 and still none of his coparceners have challenged that sale so the chances of challenging by them at this stage is very very bleak but even then it shall be in your interest to enquire about the status of all coparceners of that person before purchasing the said property.

Agree with the Expert Devajyoti Barman ji. In the given fact ancestral property can not be transferred by a single legal heir.

Yes. I agree with the experts. Though the chances of challenge are weak, but its your money involved. So nothing wrong in being careful.
