How to get back shops

There was a shop in our Grandfather's name in cloth market Indore, which after the death of grandfather was looked by father but i don't have any knowladge about the exact location as we never visited there and we reside in mumbai,We don't have any title related document like sale deed, we have a Affidavit cum declaration for lost of original property papers executed by my father in 80's plus We have assessment record of Nagar Nigam Indore of the year 1951-52 which shows our name as owner, assessment list register of 1966 which shows our name as owner but we unable to fetch further record of our property.Can we file civil suit for getting back our shop from whoever illegally possessing it & by what means?please suggest

take title search of the property . assessment record must be mentioning particulars of property . contact a local lawyer in indore

We have engaged a local lawyer in Indore Mr. Benudhar Parida, Adv. but he says no record is available in Nagar Nigam Indore & sub registrar's office which establishes link to our available documents & We don't know what is the current no. of the shop in cloth market indore & what is its location.

if no records are avilable in sub registrar office you cannot obtain any certifedcopies of documents .generally sub registrar office maintains all records . visit sub registrar office personally and contact some old employees or search clerks . offer them some incentive . they will help you

Sethi Sir, what if worst to worst we don't get any further document than what relief we can get through Civil court?

no relief . you need documentary evidence to prove you are owner of land

You says you have "we have a Affidavit cum declaration for lost of original property papers executed by my father in 80's plus" If those AFFIDAVITS ARE WITHOUT ADDRESS OR LOCATION" it will be useless.

You lost possession for over 12 years, and location is unknown , no relief in Court remains for you.
