Service matter pending with supreme court of india

Sir, This case relates to pay scales of data entry operator. Pb.& Hr. High Court has already given verdict in our favour ( data entry Operators)even after Union of India filed review in the same case. U.O.I. asked for time to implement orders but did't implement the orders of this High court since 5th Jan, 2011. Now U.O.I. has filed "SLP-CC" in Supreme Court of India. But still there is no order of listing for the last 5 months. Even till date the copy of the case has not been handed over to our council in supreme as I have already filed caveat. Now I want to know:
1. Whether Contempt of high court order be filed against U.O.I.

2. what will out come of Contempt case if filed.

3. What is your advice pl. communicate me at the earliest.

As long as SC hs not stayed HC order, Govt is bound to implement it subject to outcome of SLP. You can file CP.

SLP is in continuation to the writ decided by High Court of Pubjab & Haryana and even if no stay order has been granted even then it cannot be implemented and question of contempt of court do not arise especially when the SLP is pending before Apex Court of India.

Any Caveat filed before the supreme court is valid only for 90 days from the date of filing.

Only if the SLP is filed by the opposite party within the 90 days period of live Caveat, then the caveator will get served a copy.

The caveat is expected to be renewed. Whether your Advocate on Record got the Caveat got the renewal or not is required to be checked.

Have this aspect checked up and come back.

In any case, no contempt will succeed at this stage.
