Writ petition before high court

i am student persuing a degree for law, i have a project set by our BAR COUNCIL. we have asked a question and i am finding my self helpless. please help me out in thise problem.

The question is as follows:

Sudhir has purchased a flat from Key builder at Bhayender. He has done all the formalites, such as registration, paying stamp duty, electicity and water connection. After six month he recieved the notice from the corporation that the said building is illegally constructed and hence vacate it within week, as corporation going to demolish it. Sudhir immediately filed a writ petition before high court, contending that if the state has provided everything to the builiding then now how they can declare the building illegal?
