teacher is not getting equal salary in school as they work together & also joined that school together , similarly the other staff of school is also not getting equal pay for the equal work which the others doing in their school.

If the school is run by a Society or Trust, you can file a WRIT for equality. You can seek equal salary for the equal work, of course the seniority, educational qualification and any other relevant qualification will also be considered.

Status of school, terms of appointment agreed by the candidate, qualifications, experience, etc. all matters. Naturally, the criteria of same date of posting as teacher cannot be the only consideration for equal salary. The querist has to give complete background with particular reference to other teachers for solution to his problem.

Equality can be claimed in an unaided school. Equality is a fundamental right, so WRIT can be issued against the school even if it is a private school.

No unaided school employee can claim salary at par with aided schools'employees. Even with in same school if an M.A.has been appointed against the lecturer vacancy to teach +10 students and an other M.A. is appointed against a vacancy to teach K.G.to 5 for he has some training like B.T.C.etc.,his salary being lower can not be called discriminatory because the very two appointments are all togather different.

My opinion is that the teacher can claim equality within the same school. I don't compare unaided and aided.
