Conveyance deed or sale deed or gift deed

There is a shop in anaj mandi which was purchased in 1991 from abc and made a GPA (general power of attorney) in the name of purchaser (single owner) and further he transfered this shop in the name of four person in market committee (haryana township Authority). There was no registration with registrar at that time.

And now these four person want to get a registry of
this shop.
please tell me what is procedure of registry.

Is they need conveyance deed or sale deed or gift deed And what rate of stamp dutty attracted on this.

was agreement made in 1991?
was document duly stamped when it was transferred in name of 4 persons?

the document has to be submitted for registration within period of 4 months .

in the present case there is a delay of over 20 years . document cannot be registered now

Am agree with ajay sir.. If the current owners having good relationship with the earlier single owner mean just try to create a sale deed for today dated. I hope there is no problem to the earlier single owner..

Apart from this gift or will can't be good thing to the current 4 owners. Gift mean there should be without consideration, but the single owner sold the property with valid consideration.. Like that if he executted a will in favour to the 4 owners mean you have to wait till the single owner's death. So sale deed will be correct choice.

To tell you frankly your query has created a lot of confusion about lot of untold things.

However as i could understood from what has been stated that

(1)in the year 1991 owner 'ABC' SOLD the shop to the purchaser (say "XYZ")by a GPA.

Question posed before me is that whether this GPA was a REGISTERED DEED OR NOT??

(2)Now this GPA holder purchaser(say"XYZ")

SOLD it further to 04 persons of Market

committee.

Question posed here is that by which deed
the transfer was made to these persons by
GPA holder purchaser and when????.


In these scenario Mr. Sethi is rightly afraid and Mr. Tom rightly suggests you
and i too shall say that if GPA in favor of first buyer is REGISTERED AND ORIGINAL OWNER"ABC" is alive a direct sale by GPA holder( 1st purchaser "XYZ")can be directly
made,otherwise unless "ABC"IS READY NO DOCUMENTARY WORK IS POSSIBLE.

Then in alternate of all framing a suit may be a remedy for which you need to visit a local civil lawyer.

(1)Question posed before me is that whether this GPA was a REGISTERED DEED OR NOT??

Ans-- GPA was registered and there is no deed at that time.

(2)Now this GPA holder purchaser(say"XYZ")
Transfer it further to 04 persons.These are his relative.(without any consideration)
This took place in Market committee office (haryana township Authority)like HUDA.
This was a simple transfer in authority.


Now there 4 persons get registry of this shop.

I belong to Haryana so can reply easily.

As transfer was made by GPA holder legally in favour of 4 persons and if authority has duly transferred the shop in the name of subsequent purchasers then a Conveyance Deed is required to be registered from authority in favour of 4 purchasers and if transfer has not been effected as on date then first Conveyance Deed shall be executed in favour of original allottee and then sale-deed in favour of these persons.
