Civil case...

I am fighting a civil case and it is fixed up for Arguements for the first time. My lawyer is busy to take an adjourment during this hearing. As we have taken adjounments previously too and now we plan to take it during arguments too, Is there any maximum number of adjounments one can take during a civil case.Is there some rule to that.

No fixed rule is there but the court in general does not adjourn much during argument stages.

Does one has to give some notice to the court prior to the date of the case or not regarding the arguments.

you can always engage another lawyer for arguments .

in addition you can inform the defendants that you shal be seeking adjournment in advance .

you can inform the court that your lawyer has not been able to attned court and you have informed the other side and are willing to pay cots .

the court may grant adjournment . ask your lawyer to send his junior for adjournment if he is unbale to attend

there is no prescribed rules or law for adjournments...but keep in mind that you will not be finding unnecessary adjournments nowadays :)

According to order 17 rule 1 of C.P.C. Court may if sufficient cause at any stage of the suit may grant adjourn the hearing and for the reason to be recorded in writing. Provided that no such adjournment shall not be granted more than three times to a party during hearing of the suit.
